
Following a Judgement released on 22nd July, a Consequentials Hearing was listed last week in the High Court to determine the scale of the award due to Lynx Golf Limited, the Global Golf Brand who successfully won their recent case against former Representative Mr Kevin H. Woolgar for claims in deceit.
The Judgement, which confidently determined that Mr Woolgar had benefitted from secret commissions taken fraudulently when he sourced products for Lynx Golf over the course of a 12-year relationship, had already made an assessment that 25% of the value of all goods he had sold to Lynx over this period must be repaid back to them.
The Hearing last week sought to detail the sums involved, and an Order was subsequently made for a net repayment to Lynx of almost $4 million once pre-judgement interest was taken into account, with these sums continuing to attract interest post-Judgement until the debt is satisfied.
The Claimants, Lynx, were also awarded a proprietary injunction against Mr Woolgar, who was additionally ordered to make post-judgement disclosure of his financial information.
A spokesperson for Lynx said “The cost of Mr Woolgar’s deceit to our company has been significant both in financial and personal terms, and it is very gratifying that the High Court recognizes both this, and the ongoing obligations that Mr Woolgar now has to rectify his fraud as well as to provide us with the information we require, to see what has become of our money.
Fraud against a company is not a nameless, faceless act. We are real people, working hard to create a successful business with happy and loyal customers, and Woolgar’s actions not only set us back on our journey, but made things an awful lot harder than they should have been to get where we already are.
